Terms of Service
1. Acceptance of Terms
By accessing or using the mark2notion API service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
2. Description of Service
mark2notion provides an API service that enables bidirectional conversion between Markdown and Notion formats, allowing you to programmatically create, read, and manage Notion content.
The Service may require your Notion API integration token to interact with your Notion workspace. You are responsible for the security of your Notion credentials and any third-party API keys you use with the Service.
Specific API endpoints, features, and capabilities are documented at docs.mark2notion.com and may change over time.
3. User Accounts and API Keys
To use the Service, you must:
- Create an account with a valid email address.
- Generate and securely store your API keys.
- Keep your account credentials and API keys confidential.
- Notify us immediately of any unauthorized use at hello@mark2notion.com.
You are responsible for all activity that occurs under your account and API keys. You may not share, sell, or transfer your API keys to third parties.
4. Subscription and Billing
mark2notion offers various subscription plans with different usage limits and pricing. Current plans and pricing are available at mark2notion.com.
Subscriptions are billed monthly in advance through Stripe. By subscribing, you authorize us to charge your payment method automatically each billing period until you cancel.
Refund Policy: All payments are final and non-refundable. You may cancel your subscription at any time to prevent future charges.
Cancellation: You can cancel your subscription through the Stripe Customer Portal accessible from your dashboard. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused time or requests.
Price Changes: We may change our pricing at any time. If we increase the price of your current plan, we will notify you at least 30 days in advance. The new price will apply at your next billing cycle after the notice period.
5. Usage Limits and Fair Use
Your subscription plan determines your monthly API request limit. Details on how requests are counted for different endpoints are available in our API documentation at docs.mark2notion.com.
Usage limits reset at the start of each billing period based on your subscription anniversary date. Exceeding your limit will result in an error response until your quota resets or you upgrade your plan.
You must use the Service in good faith and not attempt to circumvent usage limits, abuse rate limiting, or overload our systems. We reserve the right to throttle or suspend accounts that exhibit abusive usage patterns.
6. User Content and Data
Your Content: You retain all rights to the Markdown content you submit and the Notion pages you access through the Service. You are solely responsible for the accuracy, legality, and appropriateness of your content.
Our Processing: We process your Markdown and Notion data only to provide the Service. We do not store your Markdown input or generated Notion blocks beyond what is necessary to complete your request. See our Privacy Policy for details.
Notion API: The Service uses the Notion API on your behalf using credentials you provide. You must comply with Notion's Terms of Service.
7. Prohibited Uses
You may not use the Service to:
- Violate any applicable laws or regulations.
- Transmit illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable content.
- Distribute spam, malware, viruses, or any other malicious code.
- Attempt to gain unauthorized access to our systems, other users' accounts, or third-party services.
- Interfere with or disrupt the Service or servers/networks connected to the Service.
- Reverse engineer, decompile, or attempt to extract source code from the Service.
- Use the Service to harass, abuse, or harm another person or entity.
We reserve the right to suspend or terminate your account immediately if you violate these prohibited use terms.
8. Intellectual Property
The Service, including its API, documentation, software, design, and all related intellectual property, is owned by mark2notion and protected by copyright, trademark, and other intellectual property laws.
These Terms grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. You may not copy, modify, distribute, sell, or lease any part of the Service.
9. Service Availability and Warranties
The Service is provided on a "best effort" basis. We strive to maintain high availability but do not guarantee uninterrupted, timely, secure, or error-free operation.
Disclaimer: THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that:
- The Service will meet your specific requirements.
- The Service will be uninterrupted, timely, secure, or error-free.
- Results obtained from the Service will be accurate or reliable.
- Any errors in the Service will be corrected.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MARK2NOTION SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, WHETHER IN AN ACTION IN CONTRACT, TORT, OR OTHERWISE, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE OR THESE TERMS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so the above limitations may not apply to you.
11. Termination
By You: You may cancel your account at any time through your dashboard or by contacting us at hello@mark2notion.com. Account deletion is permanent and irreversible. All data associated with your account will be permanently deleted in accordance with our Privacy Policy.
By Us: We may suspend or terminate your access to the Service if:
- You violate these Terms.
- You engage in fraudulent, abusive, or illegal activity.
- Your payment method fails or you have unpaid subscription fees.
For serious violations (fraud, illegal activity, system abuse), we may terminate immediately. For other issues, we will typically provide notice and an opportunity to remedy the situation when reasonably possible.
Upon termination, your right to use the Service immediately ceases. Termination does not entitle you to a refund of any fees paid.
12. Third-Party Services
The Service integrates with third-party services, including:
- Notion: For reading and writing Notion content using your API token.
- Stripe: For payment processing and subscription management.
Your use of these third-party services is subject to their respective terms and policies. We are not responsible for the availability, security, or practices of third-party services.
13. Changes to These Terms
We may update these Terms from time to time to reflect changes in our Service, legal requirements, or business practices. When we make material changes, we will:
- Update the "Effective date" at the top of this page.
- Notify you via email or through the Service dashboard.
Continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service and cancel your account.
14. General Provisions
Governing Law: These Terms are governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of law principles.
Dispute Resolution: Any disputes arising out of or relating to these Terms or the Service shall be resolved in the competent courts of Switzerland.
Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and mark2notion regarding the Service and supersede all prior agreements.
No Waiver: Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.
